Agreement<\/strong><\/p>\n<p>1.1 These terms and conditions form the basis of the agreement between you, the agent and the Owner<br \/>for the holiday rental property. (\u201cthe property\u201d)<br \/>1.2 By paying the deposit for the booking you agree that you are over 18 years of age and that you accept<br \/>full responsibility for all payments due and for the consequences of any actions of all persons who will use<br \/>the Property during your holiday.<\/p>\n<p><strong>2. Booking<\/strong><\/p>\n<p>2.1 We will confirm the booking on receipt of the deposit of the rental. This may be between 10% and<br \/>50% of the rental value. (\u201cthe Deposit\u201d).<br \/>2.2 Once we received the Deposit and Confirmed the booking then an agreement exists between us on<br \/>these terms and conditions.<br \/>2.3 We will accept a provisional booking and reserve the Property for your holiday provided that we<br \/>receive the Deposit from you within 5 working days.<\/p>\n<p><strong>3. Final Payment<\/strong><\/p>\n<p>3.1 The balance of the holiday rental fee less any Deposit will become due as per the estipulated with the<br \/>owner or house manager.<br \/>In any event and upon arrival we will ask for your credit card details as damage security deposit. We do<br \/>not charge a refundable damage deposit fee.<\/p>\n<p><strong>4. Cancellation<\/strong><\/p>\n<p>4.1 You may cancel your booking at any time provided you do so in writing to the Owner or Property<br \/>Manager, you will loose the deposit paid but you will remain liable for the 50% balance of the holiday<br \/>rental fee if you cancel within 8 weeks prior to arrival and for the full balance of the holiday rental fee if<br \/>you cancel within 4 weeks prior to arrival. We will seek to re-let the Property for all or part of the<br \/>booking period and, if successful, will refund the money paid by you less an administrative charge of<br \/>100\u20ac.<br \/>4.2 We reserve the right to re-let at a discount or for a shorter period in which case we will pay the refund<br \/>or a proportion of it if the Property is re-let for a shorter period, less the discount and administration<br \/>charge of 100\u20ac.<br \/>4.3 We do not operate any scheme of cancellation or travel insurance and you should obtain your own<br \/>insurance cover for the holiday .<br \/>4.4 In exceptional circumstances, with evidences and proves ( unexpected structural property defects,<br \/>force majeure, natural disaster,\u2026for which the house becomes inhabitable ) we reserve the right to cancel<br \/>your booking and return in full all rental fees paid by you. In such circumstances, we will assist you in<br \/>sourcing alternative accommodation of a similar standard but are not bound on any compensations.<br \/>4.5 Should the owner of the property or the property manager cancel your booking within 8 weeks prior to<br \/>arrival, he\/she will have to return in full all rental fees paid by you, assist you in sourcing alternative<br \/>accommodation of a similar standard property and pay you a maximum of 300\u20ac on the price difference of<br \/>the alternative property.<br \/>4.6 Although generally quiet, Mallorca is a working island where day to day business activities take place<br \/>and, at various periods throughout the year, local events and festivals are held. The owner does not<br \/>guarantee seclusion and cannot be held responsible for noise.<br \/>4.7 The Owner is not liable for any accidents or injuries sustained by you or any of your guests at the<br \/>property and you are advised to take out appropriate holiday insurance.<br \/>4.8 The owner has got a house insurance.<\/p>\n<p><strong>5. Change of Booking<\/strong><\/p>\n<p>5.1 We will endeavor to assist you in a transfer to an alternative date at your request although an<br \/>administrative charge of 50\u20ac will be made in such a case in addition to any increased rent due on the<br \/>property.<br \/>5.2 Changes cannot be accepted within two month of the start date of the holiday. If a change results in a<br \/>reduction in the length of the holiday it will be regarded as a cancellation.<\/p>\n<p><strong>6. Occupation of the Property<\/strong><\/p>\n<p>6.1 You must not use the Property for any purpose other than that of a holiday, events such as parties,<br \/>weddings or other ceremonies, receptions,\u2026will not be alowed unless agreed by the owner.<br \/>6.2 The number of people staying in the Property must not exceed the maximum number stated in the<br \/>advertisement.<br \/>6.3 You must not use the Property for any activity or in such a way as to cause nuisance or annoyance to<br \/>its neighbours.<\/p>\n<p><strong>7. Your Obligations<\/strong><\/p>\n<p>7.1 You agree to keep the Property and its contents in the same condition and repair as on your arrival at<br \/>the Property and to pay to the Owner upon written demand any costs incurred in making good any loss or<br \/>damage to the Property or its contents caused by your action or omission or that of any guests<br \/>accompanying you.<br \/>7.2 No pets are permitted at this property, unless agreed with Owner.<br \/>7.3 You must allow anyone authorised by the Owner to enter the Property during the holiday for<br \/>maintenance or other such reasons. We will endeavour to give you reasonable notice of such a visit<br \/>except in an emergency when immediate access must be allowed.<br \/>7.4 You must ensure that the Property is left in a clean and tidy condition on your departure at the end of<br \/>your holiday including removal of rubbish bags, binns are along the roads ( green large containers ). We<br \/>may make a charge for any additional cleaning if this is considered necessary.<br \/>7.5 You must not store nor handle in the property explosive. Inflammable, potentially disturbing or<br \/>harmfulmaterial. Health and safety regulations are to be followed at all times.<br \/>7.6 You must not sublet the property nor its contents.<\/p>\n<p><strong>8. The Owner\u2019s Right to Refuse\/Terminate<\/strong><\/p>\n<p>8.1 We reserve the right to refuse any booking.<br \/>8.2 We reserve the right to terminate this Agreement and ask you and your guests to leave immediately if<br \/>this is deemed necessary by us as a result of your behaviour or that of your guests or any other material<br \/>breach by you of the terms of this Agreement.<\/p>\n<p><strong>9. Arrival and Departure<\/strong><\/p>\n<p>9.1 The holiday rental period begins after 4.00pm on the first day of the booking period and ends at<br \/>10.00am on the day of the departure.<\/p>\n<p><strong>10. Tenancy<\/strong><\/p>\n<p>10.1 This Agreement is for the purposes of a holiday rental only and does not create the relationship of<br \/>Landlord and Tenant between you and the Owner. You will not be entitled to a tenancy or to any other<br \/>form of statutory security of tenure as a result of this Agreement.<\/p>\n<p><strong>11. Complaint<\/strong><\/p>\n<p>11.1 If you have any cause for complaint during your holiday at the Property please notify owner or our<br \/>local contact property Manager who will make all reasonable efforts to assist and resolve the issue. We<br \/>will not normally make any refund or recompense in respect of a complaint made after departure if the<br \/>complaint was not made known to us or our contact during the holiday rental period.<br \/>11.2 To resolve any disagreement that could derive, both parts will have to contact the courts and<br \/>tribunals of Palma de Mallorca, making expressed renouncement of any other jurisdiction that could<br \/>correspond to them.<\/p>\n<p><strong>12. Lost Property<\/strong><\/p>\n<p>12.1 We shall not be responsible for loss or damage to any of your belongings or for any injuries<br \/>sustained by you or any of your guests.<\/p>\n<p><strong>13. Data Protection<\/strong><\/p>\n<p>All personal data provided to us will be held and processed in accordance with the requirements of the<br \/>1998 Data Protection Act.
